VISION S.R.L. (hereinafter referred to as the \u201cOwner\u201d or \u201cBEST OPTIC\u201d), with registered office in Bra\u0219ov, Barbu \u0218tef\u0103nescu Delavrancea Street no. 10, room 3, Bra\u0219ov County, registered with the Trade Register under no. J2012000927085, fiscal code RO 30338144.<\/p><p>As a data controller, the Owner continuously monitors and ensures that the processing of personal data strictly complies with the principles and legislation on the protection of personal data, in particular the provisions of Regulation (EU) 2016\/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (hereinafter \u201cGDPR\u201d).<\/p><p>This Privacy Policy is valid starting May 25, 2018 and its purpose is to inform you about:<\/p><ul><li>the personal data processing activities carried out in relation to you, as a visitor of the Site or as a user of the functions available on the Site;<\/li><li>the personal data processing activities carried out by the Owner for the purpose of conducting its activities, as described below.<\/li><\/ul><p>BEST OPTIC may update this Privacy Policy from time to time. In such cases, data subjects will be informed via the Site about any changes before they become applicable.<\/p><ol><li><u> Definitions<\/u><\/li><\/ol><p>\u201cPersonal data\u201d means any information relating to an identified or identifiable natural person (\u201cdata subject\u201d). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.<\/p><p>\u201cProcessing\u201d (and its derivatives, including without limitation \u201cto process\u201d) means any operation or set of operations performed on Personal Data, including without limitation the collection, recording, storage, alteration, use, disclosure, access, transfer or destruction of such data.<\/p><p>\u201cVisitor\u201d means any person who accesses or uses the Site.<\/p><ol><li><u> Categories of personal data processed<\/u><\/li><\/ol><p>The categories of Personal Data processed depend on the context of your interaction with the Owner and the Site.<\/p><p>3.1 In the case of Site visitors the following categories of data, depending on your interaction with the Site, may be processed:<\/p><ul><li>In the case of suggestion forms, requests for additional information, contact and\/or complaints: last name, first name, email address, age, phone number, street, gender.<\/li><\/ul><p>3.2 In the case of job candidates:<\/p><p>3.3 In the case of Newsletter subscribers:\n\nlast name, first name, email address.<\/p><p>3.4 In the case of persons who contact BEST OPTIC through the Call Center, other phone numbers displayed on the Site or other means of remote communication belonging to the Owner, in the context of:<\/p><p>For appointments for optometric consultations, the following Personal Data of patients may be processed: last name, first name, date of birth, phone number, email.<\/p><p>For requests, complaints and suggestions submitted by phone, as well as those sent through other means of remote communication, the following Personal Data may be processed: last name, first name, home address, phone number, email address. To the extent that through such requests, including through the contact form on the Site, you directly provide other data that was not expressly requested by the Owner, BEST OPTIC will process only the data necessary for the purpose of managing your request.<\/p><ol><li><u> Purposes and legal bases for processing personal data<\/u><\/li><\/ol><p>Provision of medical services, registration of the medical services provided, communication with the patient, appointments, identification of the patient and of the services provided, informing the patient about the results of the services provided.<\/p><p>Direct marketing communications. Communication with the patient by any means: email, mobile or landline phone, phone messages (including SMS, WhatsApp), postal correspondence, messages sent via social media platforms, news regarding specific medical services available within BEST OPTIC, newsletter subscription, or providing other information that may be of interest to the patient, including offering promotional services or information about our promotions.<\/p><p>Fulfilment of legal obligations regarding archiving, financial management, health, physical and information security, monitoring our service providers to ensure the protection of the data we process, keeping records and other obligations imposed by applicable Romanian and European legislation.<\/p><p>4.1 If you are a Site visitor, we may process your data as follows:<\/p><p>For more details regarding the use of cookies, please access the Cookie Policy available on the BEST OPTIC website (www.bestoptic.ro\n).<\/p><p>Legal basis for processing: consent, performance of a contract or legitimate interest, according to the provisions of Law 506\/2004.<\/p><p>For the purpose of registering\/validating your appointments on the Site: last name, first name, age, date of birth, address, phone number, email. Depending on the specifics of your requests, the categories of data collected may differ.<\/p><p>Legal basis: legitimate interest.<\/p><p>For the purpose of managing requests sent through the suggestion, additional information request, contact and\/or complaint forms on the Site.<\/p><p>Legal basis: legitimate interest.<\/p><p>4.2 For the purposes of fulfilling the legitimate interests of the Owner, for the following purposes:<\/p><p>establishing, exercising or defending BEST OPTIC rights in court, as well as in any other legal proceedings;<\/p><p>managing any other requests, complaints, suggestions.<\/p><p>4.3.\u00a0Dac\u0103 sunte\u0163i\u00a0candidat pentru angajare\u00a0vom putea prelucra datele Dumneavoastr\u0103:<\/p><p>4.3.1 For compliance with legal obligations, for the following purposes:<\/p><p>handling requests\/complaints regarding the exercise of your rights in the context of data processing, as indicated below in section XI;<\/p><p>archiving documents according to legal provisions, observing legal retention periods;<\/p><p>managing relationships with public authorities or other entities providing a public service.<\/p><p>4.3.2 For taking steps necessary to conclude a contract, for the following purposes:<\/p><p>carrying out recruitment activities for certain vacant positions within BEST OPTIC;<\/p><p>managing any other requests, complaints, suggestions.<\/p><p>Legal basis for processing: contract.<\/p><p>4.3.3 For the purposes of fulfilling the legitimate interests of the Owner, for the following purposes:<\/p><p>carrying out subsequent recruitment activities for other vacant positions within BEST OPTIC, other than those you initially applied for;<\/p><p>managing any other requests, complaints, suggestions.<\/p><p>Legal basis: legitimate interest.<\/p><p>4.4 Newsletter subscribers<\/p><p>4.4.1 For marketing purposes, to send, through remote communication means (for example, email, phone) and other digital communication platforms, newsletters or other commercial messages regarding BEST OPTIC products and services, its affiliates and companies that cooperate with BEST OPTIC.<\/p><p>Legal basis for processing: consent.<\/p><p>Note 1: Your consent for direct marketing activities may be withdrawn at any time. For more information on how cookies are used, please access the Cookie Policy available on the BEST OPTIC website (www.bestoptic.ro\n).<a href=\"https:\/\/bestoptic.ro\/en\/\">www.bestoptic.ro<\/a>).<\/p><ol><li><u> Recipients of personal data<\/u><\/li><\/ol><p>For the purposes of processing, the Owner may disclose certain categories of Personal Data to the following categories of recipients:<\/p><p>the data subject and\/or their legal representatives;<\/p><p>BEST OPTIC representatives, entities within the group to which the Owner belongs;<\/p><p>contractual partners, namely payment processors, medical optical clinics, other corporate partners (where corporate partners are the patient\u2019s employer, the patient\u2019s data may be disclosed to the employer in the context of assessing work capacity, within legal limits and for occupational medicine purposes);<\/p><p>BEST OPTIC processors in various fields (such as security services, archiving services, marketing agencies);<\/p><p>other service and goods providers involved in BEST OPTIC activities (such as external consultants in fields like accounting, legal, tax), professional organizations, market research organizations;<\/p><p>judicial authorities or other public authorities of any kind, international organizations.<\/p><p><u>VII. Duration of processing of personal data<\/u><\/p><p>The Owner will process your Personal Data for the period necessary to achieve the processing purposes and thereafter in accordance with internal policies, as well as for compliance with applicable legal obligations, including, without limitation, archiving obligations. Data will also be stored according to BEST OPTIC internal policies that establish retention periods.<\/p><p>It is possible that after legal archiving periods are fulfilled, the Owner will anonymize the data, removing its personal character, and continue processing anonymized data for statistical purposes.<\/p><p>In the case of newsletter subscribers and marketing processing, BEST OPTIC will process data until the data subject withdraws consent or exercises the right to object according to the law.<\/p><p><u>VIII. Transfer of personal data<\/u><\/p><p>Personal Data provided to BEST OPTIC may be transferred outside Romania, to countries within the European Economic Area.<\/p><p>Outside the European Economic Area, Personal Data may also be transferred to countries that are not part of the EEA. In the course of its activities, the above-mentioned transfer countries may change.<\/p><ol><li><u> Security of personal data<\/u><\/li><\/ol><p>The Owner places great importance on the confidentiality and security of your Personal Data and undertakes to ensure its safety throughout the processing activities described in this Privacy Policy. To this end, the Owner implements appropriate technical and organizational measures to ensure a level of security appropriate to the risks associated with the types of data processed and the processing operations.<\/p><ol><li><u> Provision of personal data<\/u><\/li><\/ol><p>Providing Personal Data may be a contractual obligation or a requirement necessary for concluding\/performing a contract, may be necessary to benefit from the services provided by BEST OPTIC, to browse the Site and to benefit from the features offered. In some cases, refusal to provide Personal Data may result in the inability to benefit from services provided through the Site (for example, the inability to register your appointment\/request). For direct marketing activities, providing your data is voluntary.<\/p><p>Although BEST OPTIC requests consent for processing certain Personal Data, it is possible that such consent is not always required by law. In such situations, the Owner may use other legal bases, such as providing medical optical services, performance of a contract or legitimate interest.<\/p><ol><li><u> Data subject rights<\/u><\/li><\/ol><p>Right of access. You have the right to obtain access to your data or copies of it. You also have the right to obtain information about the nature, processing and disclosure of such data.<\/p><p>Right to rectification. You have the right to obtain rectification of inaccuracies in your data.<\/p><p>Right to erasure (\u201cright to be forgotten\u201d). You have the right to obtain the deletion of your data.<\/p><p>Right to restriction of processing. You have the right to restrict the processing of your data.<\/p><p>Right to object. You have the right to object to the processing of your data by us or on our behalf.<\/p><p>Right to data portability. You have the right to transfer your data to another controller.<\/p><p>Right to withdraw consent. Where we process your data based on your consent, you have the right to withdraw your consent at any time, at least as easily as you gave it. Withdrawal of consent will not affect the lawfulness of processing carried out before withdrawal.<\/p><p>Right to lodge a complaint with the supervisory authority. You have the right to lodge a complaint with the National Supervisory Authority for Personal Data Processing (ANSPDCP) regarding the processing of your data by us or on our behalf.
